Well two obvious options:
1. Strip it down and attempt to solve the problem yourself - downside to this is that if you bought it new from the store this may invalidate your warranty... or 2. Just return it, explain the problem, get a replacement and test it before taking it home. But it kind of sounds like its something simple... do you have a multimeter you can hook up to the batteries to make sure that they did fully charge? It may just be a case of they don't have the power necessary to drive it.
